As readers will be aware I was imprisoned for non-payment of parking fines last December.

I believe that experience trumps theory every time, so with that in mind, I took my imprisonment as an opportunity to put into practice my deductions leading on from the notion that we are governed by consent.

One the reasons that we can tell we are governed by consent is that the States of Jersey (just like the UK) is a corporate de facto government. See link below.

And that the States of Jersey operates using commercial contracts to bind us to their rules, It is easy to establish that all commercial contracts require consent to be lawful, no one can legally/lawfully force anyone into a contract against their will.

Logically, because of the fact that we are governed by consent, anything government wishes to impose on us must be with our consent, that includes income tax, social security, and all other legislation.

Now what is not apparent to most is that consent is expressly given to government by our use of the right to vote (note; registration is also used for gaining our consent)

Voting is often described as “exercising your franchise” and that is exactly what voting is, government offers us a franchise (voting) and we are at liberty to use it or not.
I found it curious that a commercial term (franchise) should be used for voting so I did some research.

From Black’s law dictionary;

Franchise. A special privilege to do certain things conferred
by government on individual or corporation, and
which does not belong to citizens generally of common
right

Elective franchise. The right of suffrage; the right or
privilege of voting in public elections.

So we see that the voting franchise or more properly known as the elective franchise is a state granted right, it is not an inalienable right because we have to enter our names on the electoral register to exercise the state granted right and the state can take that right away from us, in reality the right to vote is little more than a privilege.

The elective franchise offers us the opportunity to vote for who will become a manager (legislator) in the business called the States of Jersey, it confers upon us neither right to choose the Government (the Executive) nor the Judiciary, and as with all franchises it imposes terms and conditions on all who take up the franchise, whether your preferred choice wins or not.

It is my conviction that ‘governments’ are well past their use by date, they no longer (if they ever did) serve all of the people, but they are now just a tool of oppression controlled by the few.

If you want to be free from government tyranny the first steps are to stop voting for them and to remove your name from the electoral register.

PLAYING THE FICTIONAL COMMERCE GAME

It is vitally important to understand that law and the courts can deal with what is real and what is fictional, the real is anything that occurs in nature (e.g. men and women) and fictions are merely constructs of the mind that do not occur in nature (e.g. governments, corporations etc.).

The rule for the real and the fictional is “never the twain shall meet” commerce is a world of fiction and men and women cannot be seen in that fictional construct. However it is one of our inalienable rights to be able to act as surety for a fictional entity, in this way it is possible for us to use a fictional vessel (corporate body) to sail the fictional sea of commerce.

Governments ‘kindly’ let us use a fictional vessel to operate in commerce when our parents sign the register of births, for which it issues a birth certificate (Barron’s dictionary of banking terms defines a certificate as a paper that establishes an ownership right). The birth certificate remains the property of the government, it is unlikely that you will ever see the original certificate, but you can get a certified copy of the original.

The vessel created from the register is an unincorporated body corporate and in law is called a person (or legal person).

If you read any legislation (aka enactments, aka statutes) you will find that all statutes only apply to the person (they never use the words man/woman), these ‘laws’ can only be used on us if we consent to stand in the place of the person.

CYRIL GOES TO PRISON

On arrival at the prison reception I am put in the holding cell before ‘processing’.

After 10 minutes a prison officer (PO) opens the cell and says;

PO. “Hi Cyril can you tell me your date of birth?”

Me. “Sorry I can’t I was too young to remember.”

PO. Smiles “OK” and locks the cell door. 30 minutes later he returns.

PO. Smiling “Have you remembered your date of birth yet?”

Me. Smiling back (being polite) “No, I've told you I was too young to remember.”

PO. Not smiling now, shuts the door again.

20 minutes later an officer nurse opens the cell and asked if I would like to do a diabetes test?

On reflection, I was foolish to agree to this and as soon as I had given a blood sample I realised what I had done.

I kept good humour but thought ‘bollocks’ as I was then ushered into the processing room.

I told the PO who had come to the cell that my non- compliance was nothing personal, he accepted this in good part, and after a bit of chit chat it transpired that the PO’s father knew my sister, so as we were getting along amiably I took the opportunity to ask him what would have happened if I had refused to speak or leave the holding cell. He said that they would have called the police who would have taken me down to the police station cells to serve my time.

I asked if he was joking, he replied no that was procedure, I asked if that had happened before and he said not to his knowledge.

Now here’s a thing, the police cannot hold you in the police cells unless they suspect you of committing a crime, refusing to give consent is not a crime, so even if they hold you for the spurious reason of not giving information, they can only hold you for 72 hours (unless they invoke the terrorism law), then they must charge you and take you to court or let you go. You cannot be kept in Jail (police cells) to serve a prison sentence.

By now both prison officers are ready to process me, this is how that went:

PO. “Can you read and sign this compact.”

Me. I read the ‘compact’ which states that I agree to comply with any lawful orders that any officer gives me (basically anything they say). That I must attend any meetings that they arrange for me e.g. probation, medical, shrinks, assessments for gym, arts class, prison board etc. That I consent to any and all cavity searches. All in all what most would describe as a contract consenting to slavery!

I turn to the PO and say “I’m not signing that contract”

PO. “It’s not a contract it’s a compact and I need you to sign it”

ME. “ What’s the difference between a contract and a compact”

PO. “urm”

Me. “It looks like a contract to me, and it has all the elements of a written contract”

I put my thumb over the letters C.O.M and ask him what the remainder of the word says.

PO. “err PACT”

Me. “Isn't a pact an agreement between two or more parties?”

PO. “Yes but…”

Me. “So it’s a contract then and I am not obliged to sign any contracts”

PO. “err.. hang on ..I'll just check..”

At this point a Dawn French Esque supervisor (S) entered the room.

S. to PO. “Everything OK?”

PO. “ er he won't sign the compact ma'am”

S. to PO. Ignoring me completely “He has to”

PO. “He says he won’t”

S. Turning to me “You have to sign the compact”

Me. “I do not”

S. “You must sign”

Me. “I must not”

S. “If I order you to sign you have to sign”

Me. “Would that be a lawful order as mentioned in the compact”

S. “Yes”

Me. “Go on then”

S. “Right, I order you to sign the compact”

Me. “No, my signature is my private property and neither you, the Bailiff, the Queen, or anyone else can tell me what to do with my private property. I think you need to ask your superiors just what is and isn't a lawful order”

Needless to say I did not sign their compact.

Compact, n. An agreement or contract between persons,
nations or states. Commonly applied to working agreements
between and among states concerning matters of
mutual concern. A contract between parties, which
creates obligations and rights capable of being enforced,
and contemplated as such between the parties, in their
distinct and independent characters. A mutual consent
of parties concerned respecting some property or right
that is the object of the stipulation, or something that is
to be done or forborne.

It seems pretty clear to me that the government must have your consent to imprison you for any statutory offence.

So next time I will say absolutely nothing and do nothing they ask me to do, in fact, I'll refuse to leave the holding cell.

If you have committed a real crime you should do the time as Common Law must be adhered to by all for a society to function fairly and justly.

The overwhelming majority of prison officers treated me with respect, consideration, and were very helpful so I'd like to say thanks and hi to Lee, Alex, Paul, Chris, Maria, Andy, Craig, John, Alan, Mick and Nick there are some others whose names escape me for now.

I'll finish with a little anecdote that demonstrates the power of conditioning.

I had fallen asleep on my bunk whilst reading when there was a loud banging on my cell door, coming too, I heard someone say in a loud voice “stand-up” getting to my feet still half asleep the voice said “turn around and face the window” I did, then “put your hands on the window” just as I complied I thought WTF? and turned around to see two officers cracking up laughing, I must admit even I found it funny after I told them, intemperately, to go away.

Even semi-conscious, we tend to comply with the conditioning that has taught us to obey ‘authority’.

Jersey offers to share tax standards with EU and OECD

Senator Ian Gorst said any plans to tighten tax rules
must be the same across the globe

Jersey's Chief Minister has offered to help develop corporation tax rules in a letter to the Prime Minister.

Senator Ian Gorst has replied to a demand from David Cameron for Crown Dependencies to do more to prevent tax evasion and avoidance.

The chief minister has also written to the OECD and the EU and offered to help develop global standards.

However, Richard Murphy from Tax Research UK said: "I don't trust Jersey, nobody else should either."

He claims when Jersey has been involved in shaping tax agreements in the past, it had done all it could to block attempts to end secrecy.

Mr Murphy said despite signing tax information exchange agreements with other countries, it was almost impossible to find out any information about companies operating from the island.

He said: "Jersey is trying to put a spanner in the works to ensure the wealthy and those who are hiding their assets from tax authorities will continue to be able to do so."

'World Bank recognition'

But Senator Gorst says Mr Murphy's criticisms were unfounded.

In his letter to the Prime Minister, Senator Gorst said: "The World Bank has recognised Jersey as a leader in setting standards for beneficial ownership information for tax purposes.

"We believe [these are standards] that most EU, G8, G20 and OECD countries have yet to match fully.

"We would be please to share our expertise and provide technical assistance to other countries."

Senator Gorst said any plans to tighten international tax rules must be the same across the globe.

Jersey's government 'needs to help' with legal aid

Jersey's government needs to share the financial burden of legal aid, according to the Law Society.

The current system means lawyers are given legal aid cases on a rota for the first 15 years they practice.

The Jersey Law Society wants the States to help provide legal aid as all costs are currently absorbed by the solicitor working on the case.

Chief Minister, Senator Ian Gorst, said he would set up a working group to look into the issue of legal aid.

Neville Benbow, from the society, said lawyers were providing advice worth millions of pounds free of charge, and the States should share some of the burden.

'Extraordinary burden'

"Over 100 legal aid certificates are issued every single month and that is an extraordinary burden on lawyers. We are seeing more pressures on litigation, we are seeing more pressures on the courts and on lawyers.

"It is a difficult one because the cost is significant and the cost is rising," he said.

Mr Benbow said people using Jersey's legal aid system would not always get the specialist help they needed.

Advocate Carl Parslow said having a tailored rota for legal aid would save money and reassure clients.

The current system allocates cases on an ad hoc basis regardless of a lawyer's area of expertise.

He said some Jersey solicitors were being pushed to the brink of financial ruin looking after complex legal aid cases.

"It could take many hundreds of hours to deal with and if one is looking at a very small law firm that could have a detrimental affect on their bottom line as they would be working 100% on that case," he said.

Jersey Chamber of Commerce have reiterated their call for an inquiry into why a £75 million redevelopment of Bath Street was shelved.

Le Masurier wanted to regenerate the area, but pulled out six months ago after they 'lost confidence' in the Planning process.

Outgoing Chamber President, David Warr, says islanders have a right to know what went wrong.

Mr Warr has been speaking to ITV News about that, and other economic issues, as he departs Chamber after two years as President (Above).

A Jersey woman suffering from severe bowel disease is calling for cannabis to be legalised.

Evelyn Volante had her colon and large intestine removed because of her condition, and takes dozens of different medicines to control her condition.

But she says smoking cannabis is the only thing that relieves her muscle spasms and increases her appetite.

Hundreds of Islanders have signed her petition to legalise the class B drug for medicinal purposes.

Jersey postal staff to check on vulnerable islanders

Kevin Keen said postmen are trusted and visit every address every day

Postal staff in Jersey could be used to check on older, disabled or isolated islanders as part of their rounds.

The idea for the Call and Check scheme came from a postman after workers were asked what other services could be offered as demand for post falls.

Staff who opt in for the voluntary scheme would report anything unusual or suspicious they notice while out delivering mail.

The scheme is due to be trialled in St Brelade later this year.

The chief executive of Jersey Post, Kevin Keen, said it was a simple idea that could keep people safe.

He said letter mail value had declined and the end of VAT relief last April had "a dramatic impact on our business, as it has on the rest of the island".

'Postmen are trusted'

Mr Keen said: "Bulk mail accounted for around half of our mail volumes and these are now running around 70% lower than the same time last year."

He also said the company was not trying to substitute any of the other professions, just trying to help them.

The trial will be free, but the firm would need to look how to cover its costs when the scheme begins, Mr Keen said.

Hilary Grant from Meals on Wheels said anything that keeps older people safe is worthwhile.

She said: "I think it is a really good idea, Jersey postmen know their clients extremely well and it would be a double check for people living on their own."

The idea has caught the attention of Harvard Business School, whose representatives are meeting with Jersey postal staff and local charities later to discuss how to run the scheme.

It will be working with Jersey Post on rolling out the scheme.

ISLANDERS will have the chance to quiz States police officers this week and learn tips on how to protect against burglary and online bullying among other topics.

Friday 24 May marks 61 years of the States police force and, while it may not be a traditional birthday to mark, it is a chance for officers to invite the community into the parish halls to chat, ask questions and discuss any issues they may have. A series of events are also planned.

On that day, with the help of the honorary police and DVS inspectors, a number of road checks will also be held, and officers will talk to drivers about the ‘fatal four’ crimes – drink-driving, speeding, not wearing a seat belt and driving while using a mobile phone.

ITV News on Channel is celebrating winning two awards - including one for creating the Channel Islands' first free news app.

New Media designer Alex Pitt picked up the Technical Contribution Gold Award at the ceremony at London's British Film Institute for designing the app which allows you to view news and sports stories and videos on your mobile.

Reporter and presenter Gary Burgess took the bronze award in the Report of the Year category for his coverage of the St Helier gas tank fire in July last year.

Alex said: "I'm honoured - the ITV Channel TV News app was a big project to undertake and at the time I never thought that one year on I would be nominated for creating it, let alone to be at the awards and winning the top prize! It's a massive achievement; an experience I'll never forget. The support I had from everyone at Channel was incredible."

The awards were presented by ITV News stalwart Alastair Stewart and were attended by reporters and presenters, production staff and technical operators from ITV news regions across the UK.

Gary said of his win: "I'm chuffed to bits. To be nominated was a surprise. To pick up one of the trophies was amazing. There's so much quality journalism on show across the ITV News regions, and for the work of the journalists and technicians in the Channel Islands to be recognised in this way has made me feel very proud to be part of the team."

David Cameron warns overseas territories on tax

Prime Minister David Cameron has urged British overseas territories to "get their house in order" and sign up to international treaties on tax.

He wrote to 10 territories and crown dependencies, including the Cayman Islands and the Isle of Man, which operate low-tax regimes.

Critics claim such places are used by companies for tax avoidance or evasion.

The plea came ahead of a G8 summit in June, when the UK is expected to push for tighter tax measures.

"With one month to go, this is the crucial moment to get our own houses in order," Mr Cameron wrote in the letter.

"I respect your right to be lower tax jurisdictions... but lower taxes are only sustainable if what is owed is actually paid."

'Complex arrangements

The 10 territories that received the letter are Bermuda, the British Virgin Islands, the Cayman Islands, Gibraltar, Anguilla, Montserrat, the Turks and Caicos Islands, Jersey, Guernsey and the Isle of Man.

Some have been described by the UK government as having "complex tax arrangements".

Low taxes and light touch regulation have seen some of them become major centres for international business.

But the lack of transparency in their banking systems has left them open to accusations that they are being used to avoid paying taxes.

Mr Cameron urged them to sign international protocols designed to allow tax information to be shared more easily between countries, and also to take measures to improve their own transparency.

"Put simply, that means we need to know who really owns and controls each and every company," he said.

Tax avoidance, where companies operate within the rules to avoid paying taxes, and tax evasion, which is outside the law, have risen high on the political agenda in recent months.

High-profile companies like Google, Amazon and Starbucks have faced criticism in the UK for the low levels of tax they appear to pay compared with the size of their businesses.

On Sunday, Google's executive chairman Eric Schmidt defended the company's tax affairs.

He said the search engine giant "has always aspired to do the right thing", but added that "international tax law could almost certainly benefit from reform".

Writing in the Observer, he said he wanted "to move the debate forward".

JUDGMENT

THE BAILIFF:

1. These are disciplinary proceedings concerning Advocate Carly James (“the respondent”). On 11th January, 2013, she pleaded guilty to one count of being concerned in the supply of a Class B drug, namely cannabis resin, for which she was fined £600 in the Magistrate’s Court.

2. In most circumstances, a conviction for being concerned in the supply of controlled drugs will inevitably lead to an advocate being struck off. But it is said that the circumstances of this offence are highly unusual and that the Court should not impose such a severe penalty.

The facts

3. There is no dispute as to the facts which we find to be as follows.

4. The respondent is 31 and was born and educated in Jersey. She obtained a law degree from Kingston University and subsequently the LPC from the College of Law, Chester. She returned to Jersey in 2005 and joined Appleby. She has worked mainly in the family law department. She was sworn in as an advocate of this Court on 6th October, 2011.

5. She met a man (“the partner”), who is some nine years older than her, approximately 6½ years before her arrest on 11th September, 2012, and they began to live together about one year later in an apartment purchased in the respondent’s sole name.

6. It appears that, despite living together, they lived comparatively separate lives and did not generally share close friends or socialise frequently with joint friends.

7. She says that she was aware that the partner occasionally smoked cannabis when he was with his friends. She said that he did not do it in her presence or in the flat. She says that she told him she did not approve and she made her feelings clear to him. It was a point of contention in their relationship and was therefore something that, in the main, he kept from her.

8. On 11th September, 2012, the police executed a search warrant at the flat. They found 156g of cannabis with a retail street value of between £1,700 and £2,500. The respondent asserted at the time and continues to assert that she had never seen this cannabis before. This is accepted by the Attorney-General. She and the partner were arrested and charged with possession of the cannabis.

9. The respondent immediately moved out of the flat and returned to live with her parents where she has remained since then. She ended the relationship with the partner.

10. During the search, the respondent’s mobile phone was seized and the police recovered texts from her phone which suggested that she had been concerned in the supply of controlled drugs to a friend.

11. It would appear that a female friend of hers texted the respondent on two occasions in May 2012 requesting some “pizza”, which it is acknowledged was a code name for cannabis. It is accepted that the respondent did not ask the partner to supply any cannabis on either of those occasions, although unfortunately she did not reject the request out of hand; she replied along the lines that she had been unable to find any “pizza” (on the first occasion) or had not yet been able to check with “pizza man” (on the second occasion).

12. Finally on 25th July the friend texted again saying “Can you ask davy about the pizza”. The respondent replied indicating she could supply £50 worth. There were then certain further exchanges from which it is clear that a certain amount of “pizza” had been supplied. It is accepted by the Attorney-General that the amount in fact supplied by the partner to the friend was £10 worth.

13. The respondent was arrested on 23rd October, 2012, on suspicion of being concerned with the supply of cannabis. She made no comment when interviewed under caution and was charged on 15th November before the Magistrate’s Court. She pleaded not guilty.

14. Subsequently, on 11th January, 2013, she pleaded guilty to an amended charge which confined the date of supply to a single instance on or about 27th July, 2012. As already mentioned, she pleaded guilty and was fined £600. Her not guilty plea to the possession charge in relation to the cannabis found in the flat was accepted.

15. The background to the offence was explained to the Magistrate and has been explained to this Court in Miss James’ affidavit. She states that the friend and her husband smoked cannabis occasionally and they were aware that the partner also smoked cannabis. They were also aware that the respondent disapproved and is not a cannabis user. Nevertheless, in May 2012 the friend asked the respondent to ask the partner if he could get her husband a small amount of cannabis. Despite the fact that her text in response implies that she had asked the partner and that he could not get any cannabis, the respondent asserts that this was not actually the case and she did not ask the partner for assistance. But rather than simply admit that she was unwilling to help, she adopted this approach because she thought it might put the friend off. It did not, as the friend made a further request on 23rd May. Again the respondent did not in fact ask the partner about any cannabis, although she replied to the friend simply stating that she would check on his return as he was out. However, when the friend approached her again in July, she replied positively. She approached the partner and he supplied approximately £10 worth of cannabis to the friend. The respondent had no involvement in the supply itself; her role was limited to acting as intermediary and passing on the request from the friend to the partner. She received no financial benefit from the transaction and the actual supply was by the partner to the friend.

16. The Court accepts that, so far as offences of being concerned in the supply of controlled drugs go, this must be at the very bottom of the scale in terms of gravity given the limited involvement of the respondent and the very small amount of Class B drug supplied. Nevertheless, any offence of being concerned in the supply of controlled drugs is serious and for an advocate to commit such an offence is a serious breach of an advocate’s duty to uphold the standards of the profession.

Submissions

17. The Attorney-General reminded the Court of the observations in Bolton-v-Law Society [1994] 1 WLR 512 and referred also to various disciplinary decisions in England and in Scotland in connection with the possession or supply of controlled drugs. Having done so, he moved that the appropriate sanction in this case would be suspension for a period of six months.

18. Advocate MacRae emphasised the limited nature of the offence committed by the respondent. The police had analysed all the respondent’s text messages (some 3,500 in number) over the year prior to her arrest and had not found anything which indicated involvement with drugs. Her sole involvement was that she had passed on a request from her friend for a small amount of cannabis to her partner and he had then supplied £10 worth of cannabis to the friend. She had merely been the link to pass on the request. She herself was not a cannabis user and disapproved of it. She bitterly regretted her involvement and was full of remorse. He explained how she had long displayed an interest in law and that her swearing-in as an advocate on 6th October, 2011, had been the proudest day of her life. She worked exclusively in the area of family law which was an area where she felt she could give advice and assistance to clients who were often facing emotional and difficult times in their lives. She was motivated in her professional career by a desire to help others and that area of law enabled her to do this.

19. He referred to the many glowing references, including a number from senior members of Appleby, which firm had stood by her since her arrest. The references spoke of her enthusiasm, dedication, hard work and integrity.

20. He then turned to consider the various decisions referred to by the Attorney-General but contended that a number of these supported his case that a reprimand and/or a fine would be sufficient. He also referred to the fact that over the last few years, two senior advocates had been convicted of driving a motor vehicle with excess alcohol but they had not been brought before the Court. He submitted that this showed an inconsistent approach.

21. In summary, he submitted that this was the least serious case one could imagine of being concerned in the supply of a controlled drug. It had been committed by a young advocate of otherwise unblemished character who was highly thought of and who was just setting out on her career. He urged the Court to proceed by way of public reprimand or at worst a fine so that she could continue with her chosen career.

Decision

22. The Court accepts that it should proceed on the respondent’s version of events as set out above. This was a one off supply and her role was limited to passing on the request to the partner as set out above. Having said that, it was the third time that the friend had made this request and it is hard to understand why the respondent did not simply say on the first occasion that she was having nothing to do with such a request. She was an advocate and she knew the serious view which the Court takes of any offence of supplying or being concerned in the supply of controlled drugs.

23. Turning to the previous decisions referred to, a number of them were very different in that they related to the supply of substantial quantities of class A drugs for which, not surprisingly, the lawyer in question was struck off. The only ones which provide some assistance are as follows.

24. In O’Connor (2011) a Scottish solicitor went to a public house where he met up with a group of persons, one of whom was Mr A, whom the solicitor had not met previously. Whilst in the pub the solicitor purchased some cocaine from the group which included Mr A. He then invited Mr A and the rest of the group back to the premises of his firm where, after their drugs ran out, he shared some of the cocaine he had purchased that evening for his personal use with members of the group. Mr A later became unwell due to the combination of drink and drugs and died the next morning. However, the post mortem and toxicology reports determined that any cocaine supplied by the solicitor did not cause the death of Mr A. The solicitor, when interviewed, made full admissions and pleaded guilty to supplying a controlled drug to another for which he was given a community service order. At the disciplinary hearing, he was censured and fined £10,000.

25. Mostyn (2012) was an English barrister who was in possession of cocaine and ecstasy. The disciplinary tribunal reprimanded him and fined him £250.

26. In McBride (2012) a barrister was found in possession of cocaine. He was subsequently cautioned by the police. The disciplinary tribunal reprimanded him and fined him £1,000.

27. In Green (2011) a barrister drove a vehicle after consuming excess alcohol and was found in possession of cocaine. He was reprimanded and fined £1,000.

28. Finally in Edmonds (2011) a barrister drove a vehicle after consuming excess alcohol and was found in possession of cannabis. He was reprimanded and fined £400 as regards the motoring offence with no further action concerning the possession charge.

29. In our judgment, each of these cases involved a less serious drug offence than that of the respondent. So far as O’Connor is concerned, it was a case of social supply whereas the respondent in this case was concerned in a commercial supply, albeit of a very small amount. As to the four other cases, they all involved mere possession of a controlled drug with no element of supply.

30. In any event, as the Attorney-General pointed out, it is the case that the Royal Court takes a stricter line on the supply of controlled drugs than do the English courts and accordingly penalties imposed by disciplinary tribunals in the United Kingdom are of limited assistance. Given the seriousness with which the Royal Court treats offences of supplying controlled drugs, advocates and solicitors must appreciate the seriousness of becoming involved in such conduct.

31. As to Advocate MacRae’s point concerning the two senior advocates who were not brought before the Court for offences of driving a motor vehicle with excess alcohol, the Court has no information about those offences and in any event a wrong decision not to refer a previous case does not mean that the Court should on this occasion do anything other than impose the correct sanction for this particular offence. We do however invite the Attorney-General to consider the relevant procedures so as to ensure that any criminal offence by an advocate or a solicitor is brought to his attention so that he can determine whether the matter should be brought before this Court.

32. In the cases of AG-v-Michel [2012] JRC 099 and AG-v-Begg [2012] JRC 209 this Court endorsed the observations of Sir Thomas Bingham MR in Bolton and we would refer in particular to the passage at page 519 of that case:-

“Because orders made by the tribunal are not primarily punitive, it follows that considerations which would ordinarily weigh in mitigation of punishment have less effect on the exercise of this jurisdiction than on the ordinary run of sentences imposed in criminal cases. It often happens that a solicitor appearing before the tribunal can adduce a wealth of glowing tributes from his professional brethren. He can often show that for him and his family the consequences of striking off or suspension would be little short of tragic. Often he will say, convincingly, that he has learned his lesson and will not offend again. … All these matters are relevant and should be considered. But none of them touches the essential issue, which is the need to maintain among members of the public a well-founded confidence that any solicitor whom they instruct will be a person of unquestionable integrity, probity and trustworthiness. Thus it can never be an objection to an order of suspension in an appropriate case that the solicitor may be unable to re-establish his practice when the period of suspension has passed. If that proves, or appears likely, to be so the consequence for the individual and his family may be deeply unfortunate and unintended. But it does not make suspension the wrong order if it is otherwise right. The reputation of the profession is more important than the fortunes of any individual member. Membership of a profession brings many benefits, but that is a part of the price.”

33. We have carefully considered the powerful mitigation put forward by Advocate MacRae. We note the limited nature of the respondent’s involvement in the offence and the evidence as to her good character from the glowing references which we have read. We acknowledge the effect that this has had on her and the risk that a suspension may have as to her future prospects. Nevertheless, by a majority, the Court has concluded that a reprimand or a fine – and Article 26(h) of the Law Society of Jersey Law 2005 provides that only one such sanction may be imposed – would be insufficient to uphold the dignity and reputation of the profession. An advocate is an officer of the Royal Court and the commission of an offence of the gravity of being concerned in the supply of a controlled drug cannot be regarded so leniently.

34. However, in view of the matters put forward by Advocate MacRae and the fact that it is hard to imagine a case of being concerned in the supply of controlled drugs which is further down the scale of seriousness, the Court concluded that a period of two months’ suspension would meet the justice of the case. Accordingly that was the disciplinary penalty which was imposed at the conclusion of the hearing on 19th March.

Co-op members to share £8.65 million

CO-OP members across the Channel Islands will be given back £8.65 million in dividends for money they spent last year, it has been announced.

The figure – which equates to a four per cent dividend – was confirmed this week at the society’s annual general meetings in Jersey and Guernsey.

It was also announced that the company had turned over £159.9 million in 2012, down two per cent on the year before, and recorded gross profits of £49.8 million.

Senator Philip Ozouf will act as observer for the Cayman Islands election

A Jersey minister has been asked by the Commonwealth Parliamentary Association to observe elections in the Cayman Islands.

Treasury Minister Senator Philip Ozouf will travel to the island alongside observers from Scotland, Bermuda and Malta.

He will stay in the islands for a week before the voting on 22 May.

Of the six observers, three are from the British Islands and Mediterranean region and three from the Caribbean.

Constable Len Norman the chairman of the Jersey branch of the Commonwealth Parliamentary Association, said he was particularly pleased Jersey was selected to take part in this important aspect of the association's work.

"There is great diversity within the association, and yet there are still many issues that are common to us all. One such issue is our shared commitment to democracy," he said.

Senator Ozouf said he was expecting a busy week in the Cayman Islands.

"Jersey is strongly committed to its position in the Commonwealth and we are always ready to demonstrate that commitment by lending support to fellow Commonwealth countries."

More than half of people on low incomes in Jersey are finding it difficult to pay their rent, according to a government housing report.

The e States Statistics Unit found they were paying more than 30% of their gross income in rent, its official definition of "housing stress".

Low earning in Jersey is anything below the average salary of £34,000.

Housing minister Deputy Andrew Green said more needed to be done to lower the price of rental property.

The average rent for a three-bedroom house in 2012 was £1,740 per month.

'Housing stress'

Mr Green said: "The best thing we can do to lower the price of rental property, or at least prevent them from going up further, is to increase supply."

The 2012 Jersey Housing Affordability Index looked at the ability of people on low incomes, first-time buyers and key workers, such as teachers and nurses, to house themselves affordably.

It revealed about a third of low earners who owned their homes, and those in States housing, could be considered as being in "housing stress".

Mr Green told BBC News: "Housing stress is around the money people have to pay their rent when you take all their income in, it is the proportion they spend on rent or a mortgage and what they have left."

Social Security Minister Senator Francis Le Gresley announced plans earlier to provide more support for people struggling to pay private rent.

Radical plans to improve social housing in Jersey look set to be rubber-stamped today.

The thirty-year plan to change the face of States owned houses in the island is being debated by the States.

The Housing Minister, Deputy Andrew Green, has called his masterplan "the biggest change ever" for social housing.

It will see more than 4,000 States homes transferred to a Housing Association. The new not-for-profit company will be free to borrow more money to build homes faster than the government can, and improve existing properties.

Deputy Andrew Green said: "If the income is right for States housing then we can go out and get a mortgage on any development providing we've got a site, and the rents that come in can pay for the maintenance over the next 25 years and the mortgage.

"We can supply any homes that are required, the limiting factor of course will not then be finance but it will be the sites and I look to my colleague the Planning Minister to provide those sites."

The plan is to build 434 new units, refurbish 578 of the current ones, and sell-off 300 others as affordable homes over the next 20 years.

But the Housing Scrutiny Panel are concerned the proposals won't meet the current demand for social housing.

There are about 500 families in need of housing, 150 of which are in urgent need and are on the highest priority waiting list, classed as 'homeless'.

The panel's chairman, Deputy Kristina Moore said: "We are concerned that under the existing plan there is only a net gain of 287 new social housing units being created after some units have been sold off over the next 20 years.

"We feel that's not good enough because it doesn't fulfil the need we have now, let alone the need we may have in the next 20 years."

She added: "I feel very passionately that we should be going out and finding empty units of accommodation that we can offer to people under social housing conditions so that we can help fulfil the great demand that we currently have for these units.

"I'm hoping that some of my colleagues might come out and look at some empty properties with me and consider being able to reclassify them for social housing and to refurbish them as quickly as possible so that we can make some units available."

Reality star Rylan on 'top secret projects' in Jersey

X Factor finalist, Celebrity Big Brother winner and TV presenter Rylan Clark is in Jersey.

The perma-tanned Essex-entertainer is visiting the island to see friends and work on a number of 'top secret' projects.

He is in-demand right now having just been signed as the new presenter of Big Brother's Bit On The Side.

But he has also told ITV News he has ambitions to be a pop star as well as a TV show host.

And while he was here, he came face-to-face with some familiar faces.

He told us: "I've just come over to Jersey to see the island, I've got some friends over here so it's nice to come over here and do some work and have a bit of a chill out as well.

"It's such a lovely island. I've never been here before, so it's so lovely to be here.

Jersey bomber veterans drop in to mark ‘Dambusters’ raid

Flight Lieutenant Ken Trent and retired Warrant Officer Peter Turley

TWO Jersey veterans who flew bombing missions during the Second World War will join the Islands Royal Air Force branch this evening to commemorate the 70th anniversary of the crucial ‘Dam Busters’ raid.

To mark the occasion the Jersey RAFA will show ‘The Dam Busters’ – the classic film that dramatised operation Chastise and the moment when British bombers successfully destroyed dams in the heart of a major German industrial centre in the Ruhr Valley using specially designed bouncing bombs.

Flight Lieutenant Ken Trent, a former pilot who flew Lancaster Bombers with 617 Squadron after the famous mission, and retired Warrant Officer Peter Turley, who served as a rear gunner during the Second World War will join the RAFA (Jersey) branch as they mark the anniversary.

The pair will attend the free screening of the film at Victoria College’s Howard Davis Hall at from 7.30 pm and Flt Lt Trent will be on hand to answer any questions the audience might have about what it was like to fly the RAF’s huge bombers.

Inquest into Sarah Groves' murder on Friday

The inquest into the death of murdered Guernsey girl Sarah Groves will open on Friday.

The announcement comes on the day her family have announced they are setting up a charity in her memory.

The 24-year-old from Guernsey was murdered while travelling in Kashmir in April.

A foundation is being set up in her name, and the family will reveal details at a memorial service which will be held at St James on the 8th of June.

The Groves family say anyone is welcome, and they are already accepting donations to the new charity.

Peter Harwood Not Being Suckered By Jersey

The Chief Ministers of Jersey and Guernsey have committed to further co-operation but say a Channel Islands Confederation isn't on the cards.

They were speaking to a group of business leaders and politicians who overwhelmingly voted for uniting the islands.

In a show of hands around 90 per cent of the audience showed support for the concept.

But Guernsey's Chief Minister, Deputy Peter Harwood, expressed concern that perhaps the people weren't ready for their islands to be integrated.

He said: "We have to carry the popular will and I think there's always been a concern in Guernsey that we will be the smaller partner and it's not a partnership of equals and it'll take a long time I think to convince the Guernseyman that actually it does make sense to have a confederation."

Deputy Harwood believes the best approach is to further co-operation.

He said: "I think we need to show people that co-operation can work and that is for the benefit of both islands and then we can build from that."

Over the past few years the islands have made progress in working more closely together.

There are now several roles which cover both Bailiwicks such as a Competition Regulator, Data Protection Commissioner, Civil Aviation Director and Health Protection Officer.

There are also plans for a pan-island Financial Ombudsman.

The islands have also combined resources in training police recruits and prison officers, they have set up a Brussels office to represent the islands in the EU, and last year they joined forces in their fight to save Low Value Consignment Relief.

Over the next year the Ministers hope to establish a joint Financial Services Commission, a pan island aircraft registry, work together on a common energy policy and share resources within the Health Department.

Jersey church investigation underway

Dame Heather Steel DBE has begun her investigation into a Jersey church safeguarding complaint from 2008.

The Dame's inquiries will feed into a bigger investigation into how good Jersey's church is at protecting people.

Dame Steel is a former Court of Appeal Judge in Jersey, having retired last year, and is a former High Court Judge in England and Wales.

The investigation follows the independent Korris Review into Safeguarding in the Deanery of Jersey, published in March 2013, which considered the case of a vulnerable adult parishioner, who had made a complaint about abusive behaviour by a churchwarden.

The Investigation will now make further inquiries, find facts and make recommendations about whether or not disciplinary complaints should be brought against any member of the clergy as a result of the matters raised in the Korris Review.

The Bishop of Winchester, the Rt Rev Tim Dakin, said: "We are enormously grateful that Dame Heather has offered her considerable expertise to us all.
"As I have said before, we cannot stress enough the importance of safeguarding.
"We are committed to understanding fully the circumstances of this complaint and to ensuring that we take whatever action is required to ensure that our Church is a safe haven for the vulnerable.

Jersey moves to prevent measles outbreak

A steady flow of parents have made use of a special measles, mumps and rubella (MMR) immunisation clinic at Jersey's General Hospital.

It was set up to help prevent an outbreak of measles in the island.

A total of 83 chldren were vaccinated.

The free clinic was aimed at children who previously missed out on having either one or both MMR vaccination doses.

It comes as England and Wales experience the highest level of measles cases for 18 years.

The measles epidemic in Wales is continuing and some areas in London are now seeing measles outbreaks, with the number of cases of measles in London between January and March having doubled compared to the same period in 2012.

In recent weeks, the Public Health team have written to more than 500 parents of children in school years 5-8, whose records showed they had not received two MMR vaccine doses.

Jersey's Head of Healthcare Programmes, Dr Linda Diggle, said: "We haven't seen any cases of measles in Jersey for some years but we aren't complacent - we always have children moving into Jersey from other areas and children, parents and our population are continually travelling to and from the UK, often via London, so we need to keep our children protected."

"In Jersey, we currently have very high MMR vaccine uptake amongst our under 5s, however this wasnt always the case. In the early years of the millennium, uptake of MMR vaccine in Jersey plummeted in the years in and between 2002 and 2005. This was a direct result of adverse publicity in the national media. These children are now aged around 10-13."

Dear Health Minister

I have noticed over the last few weeks that the JEP, Channel TV, and now BBC Jersey are promoting vaccines, particularly the MMR vaccine. I have done some research over the past few years on vaccines and I must confess that I cannot find any individual or group outside of Government or the Pharmaceutical Industry that has anything good to say about vaccines. In fact, everything I have researched points to the complete opposite.

If vaccines are safe, as being asserted by some of Jersey's government health practitioners, could you please ask these experts to publish a paper declaring the entire contents of these vaccines for the benefit of parents in Jersey as I am sure you would want to allay the fears of the public which you have been elected to serve.

I look forward to the publishing of a full and comprehensive paper on the subject in the near future.
