"Jersey Magistrates Oath Of Office - But Which Oath Of Office?"

"French, Jersey French, Normandy French &

Plain Bloody English!"



I spoke with Cyril this morning with regards to obtaining a copy of the Jersey Magistrates Oath of Office, this was in conjunction with the posting we did on the accessibility of law to the common pleb, which link is below.

I though we should get a copy to see just what our magistrates are obliged to do on behalf of the people they are grossly overpaid to protect from corruption and tyranny. I thought it might also be advantageous in Rose Shepherd's case, which is at the link below.

On talking to Cyril, he remembered that he had requested the same document a few years ago from the Bailiff's Office. After a lengthy search on his computer he managed to find the Email sent to him from the Bailiff's Judicial Secretary, Debbie Le Mottee, which is below.

All seems quite above board and honourable, doesn't it?

However, knowing of the problems the plebs face with getting an honest transcription of Jersey Laws, I decided to do a little checking myself and ran this translation through 'Google Translate' the results took me back a little to say the least. Below is the translation from Google Translate.

Not quite the same is it?

The above translation appears to give a magistrate choices of how they deal with matters, whether to act honourably, or not. I will be getting a professional translation done to clarify this ambiguous scrawling and shall revert back to readers once this has been accomplished.

Not contented with this, I then took it upon myself to get another couple of translations using different software from different manufacturers, the results are below.

In the 21st century it is anathema that laws and public oaths affecting everyone on this island should be written in untranslatable old french,which are open to arbitrary interpretation by non-native french speaking lawyers and judges.There is no valid excuse for this situation to continue. When people are purposefully impeded from access to the meaning of legal information there is little doubt that we are being deceived and lied to by the most corrupt judicial system in the 'free' world.

  1. Must keep reminding you that the problem has been complained about for centuries with petitions sent of regularly to HM King or Queen and/or Duke. The circus surrounding the Royal Mace, the Bailiff's slightly higher throne and all the other trappings of a Mikadoesque administration will be promoted as wonderful for many more decades yet.
    I forget if it was the Le Quesne or Clothier Review of Jersey Legal Services that put forward the suggestion of tearing up Jersey Law completely and adopting the laws of another territory - but it makes no difference. That Review has been ignored along with so many other progressive attempts to Reform things here. Of course you and I can dance around the maypole on 28 September this year in clebration of Jersey Reform Day and the thousands who have demanded reform in the past - and we can join them with the reformers of today and those who might yet speak out in the future...but without a determined effort that Saturday will slip by without any significant activities...as per usual.

  3. You will not be able to translate this oath into English.................why? Because it wasn't written in English. There are numerous words in numerous languages that will not have an equivalent! Its called untranslatable, look it up.

    There are about 250,000 words in English alone, it's naive to think that these words will represent all of human emotion/experience. We also use French words in English as English words don't exist. For example: cul-de-sac, literally means 'butt of the sac'.

    As another example:

    French: Dépaysement, this means to have a feeling that you are not in you own country. No english word will capture this meaning. Translators use several tools when working.

    Adaptation, borrowing, calque, compensation and paraphrasing.

    I teach languages and have studied various forms, one being French and Norman French. Some of the words in the oath simply have no English counterpart. The use of computer algorythms like google and other software will give you far from accurate results. The translation sent with the french original is by far the closest as far as I can see.

      Well, perhaps you could explain why you failed to notice that a whole sentence was missing from the translation that you say is "by far the closest".

      I didn't miss it and I can't even read French!!!

    2. I think the additional sentence you are referring to is the one referring to a judge or magistrate acting upon their conscience. Not sure I'd vilify Anon @ 5.55pm for overlooking this. Machine translation cannot be relied upon except in helping to gather the gist of a piece of foreign text.

      I would tend to agree with the comments of Anon @ 5.55pm.

      Only a court of law can properly interpret an oath of office and, if we assume a Jersey court is indeed corrupt (which it is), then it will not be the words of the relevant oath that will be in dispute but whether the act complained of falls within the scope of those words. True to form, you will find willful blindness substituted with honest oversight, and fraudulent or perjurous statements substituted with misundertstanding and confusion.

    1. I have no doubt that it is anon, they really are starting to panic now and have never been scrutinized in this way before.

      Myself and Cyril are happy to take their, err, official version as gospel though, especially as it negates all the get out clauses in the other translations.

      For instance, a real biggie is the word "GOD" not the other deity the "Lord God" but just plain old "GOD" that is immensely helpful to our common law cause, read your KJV bibles as "GOD" only appears in Genesis for the briefest of periods where he grants us dominion over the earth, and all things upon it. This is very bad for them.

      In fact, the whole thing is very bad for them as every day they break this Oath of Office by not even acting under it when pretending to be magistrates whilst committing fraud on the people. If not under their OoO they have no claim to any authority over us, and are committing treason against her majesty and the people.

    1. Thanks for the LINK above anon, the simple way to deal with jurisdiction is not to consent to it. Convene your own court of inherent common law jurisdiction, to ask them for anything is to consent to their jurisdiction. You do not ask for, or require their company's services :)

  6. The official translation misses out the last line which should read "And you promise to remain true in all your duties, upon your conscience."

    But a God fearing man's conscience stands above the law, because a God fearing man's conscience is God, or at least that part of a man which is closest to God. So if they break their duties they will not only suffer in the next life, but they should also be tormented in this.

    I would be wary of invoking God however, as it is very difficult to define... remember - if it exists it is God's will - so if a Law exists it is because God wills it to, but a man's conscience stands above the law - a reasonable man (who must answer to God at his final judgement) will always follow his conscience before blindly following the Law.

    Which is why all Laws must be obeyed; except when it is reasonable to do otherwise.

    Great mind often think alike! or is it fools seldom differ? either way I peed myself laughing at the bailiff trying to cock his leg over the fence and the copper telling him to be on his way.

    More reaction to our actions yes this is what we need to see.
